More Garbage from the FCC

According to FCC Chair Kevin Martin, FCC rules wouldn't allow a merger between XM and Sirius. I can understand exercising jurisdiction over terrestrial radio, but where does the FCC get off thinking has jurisdiction over satellite radio, a subscription service that operates under a different concept of "public airwaves" than terrestrial radio does?
